Terms of Service

Acceptance of Terms

Welcome to the websites and online services operated by the Illinois Education Association
(collectively, “our sites”). The Illinois Education Association (“we,” “us,” or “IEA”) provides our sites as a
service to you, subject to the following Terms of Use (“TOU”). Unless explicitly stated otherwise,
all features of our sites are subject to these TOU.

By accessing or using our sites, you agree to be bound by these terms. If you do not agree to any part of these terms, you are not authorized to use our sites. We reserve the right to modify these TOU at any time. Your continued use of our sites after any changes are posted constitutes your acceptance of the revised terms.

Description of Service

Through our sites, IEA seeks to provide members, education professionals, and supporters of public education with access to a wide range of informational and educational resources. We hope you find our sites useful.

IEA reserves the right to modify, suspend, or discontinue our sites, or any portion thereof, at any time and for any reason without prior notice. You agree that IEA shall not be liable for any such modification, suspension, or discontinuation.

Registration Obligations

If you choose to register for an account on our sites, you agree to provide true, accurate, and current information and to promptly update that information to keep it accurate and complete.

Privacy Statement

Your registration information and any other personally identifiable information you provide through our sites are subject to our Privacy Policy. Please review the Privacy Policy for information about how we collect, use, and protect your information.

Password Security

You are responsible for maintaining the confidentiality of your user ID and password. You agree to accept sole responsibility for all activities that occur under your account.

User Conduct

As a condition of using our sites, you agree not to use them to:

  • Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity;
  • Forge headers or otherwise manipulate identifiers to disguise the origin of any content transmitted through our sites;
  • Harm minors in any way;
  • Harass, threaten, intimidate, embarrass, or cause distress or unwanted attention to others;
  • Transmit or make available any content that is unlawful, harmful, threatening, abusive, defamatory, obscene,
    hateful, or otherwise objectionable, as determined by IEA;
  • Infringe upon any patent, trademark, copyright, or other proprietary rights;
  • Send unsolicited advertising, promotional materials, bulk email, or other solicitations;
  • Transmit content containing viruses, malware, or other harmful code;
  • Interfere with or disrupt our sites, servers, or networks connected to our sites;
  • Violate any applicable local, state, national, or international law.

This list is illustrative, not exhaustive. IEA reserves the right to determine, in its sole discretion, whether conduct violates this section.

User-Submitted Content

By submitting content to IEA through our sites, you represent and warrant that:

  • You own or have the necessary rights to the content;
  • The content does not infringe upon the rights of any third party; and
  • The content complies with these TOU.

You grant IEA a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to use, reproduce, modify, publish, translate, create derivative works from, distribute, and display such content worldwide in any medium. You agree that no compensation will be provided unless expressly agreed to in writing.

Indemnification

You agree to indemnify and hold harmless IEA, its affiliates, officers, directors, employees, agents, and partners from any claims, damages, losses, liabilities, or expenses (including attorneys’ fees) arising from:

  • Content you submit;
  • Your use of our sites;
  • Your connection to our sites; or
  • Your violation of these TOU.

Termination

IEA may terminate or suspend your access to our sites at any time, for any reason, without notice. IEA shall not be liable for any termination or suspension of access.

Links

Our sites may contain links to third-party websites. These TOU do not apply to linked sites. IEA is not responsible for the operation, content, services, advertising, or practices of linked sites and does not endorse them.

Messaging Terms & Conditions

By providing your cell phone number, you agree to receive texts to your number from the Illinois Education Association. Texts will include messages about events, member benefits, and information impacting their profession. Msg frequency varies. Reply STOP to opt-out. Reply HELP for help or more information. Disclaimer of Warranties

YOU AGREE THAT:

A. YOUR USE OF OUR SITES IS AT YOUR SOLE RISK. OUR SITES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. IEA DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

B. IEA MAKES NO WARRANTY THAT:

  • The content available via our sites is accurate, reliable, or correct;
  • Our sites will be available at any particular time or location;
  • Any products, services, information, or materials obtained through our sites will meet your expectations;
  • Any defects or errors will be corrected; or
  • Content available via our sites is free of viruses or other harmful components.

Because some jurisdictions do not allow the exclusion of certain warranties, some exclusions in this section may not
apply to you.

Limitation of Liability

YOU AGREE THAT IEA, ITS AFFILIATES, AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OF, OR INABILITY TO USE, OUR SITES. THIS LIMITATION APPLIES WHETHER IEA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, OR ANY OTHER BASIS.

Because some jurisdictions do not allow the exclusion or limitation of certain damages, some limitations in this section may not apply to you.

Intellectual Property

Unless otherwise indicated, content on our sites is the property of IEA or its licensors and is protected by copyright, trademark, and other laws. You may display content solely for your personal, non-commercial use. You agree not to reproduce, modify, publish, translate, create derivative works from, distribute, display, retransmit, or sell any content without prior written permission of the respective owner.

Copyright Infringement

IEA respects the intellectual property rights of others. If you believe that your work has been used on our sites in a manner that constitutes copyright infringement, please submit a notice to our Copyright Agent including:

  • An electronic or physical signature of the person authorized to act on behalf of the copyright owner;
  • A description of the copyrighted work claimed to have been infringed;
  • A description of where the allegedly infringing material is located on our sites;
  • Your address, telephone number, and email address;
  • A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
